Expungements

Individuals with criminal convictions often have difficulty finding stable employment. Modern information services make it relatively easy for employers, professional licensing organizations, and other groups to lookup the criminal history of any applicant. Fortunately, many defendants are eligible for a process known as expungement, under which an individual is released from all penalties and disabilities arising from conviction.

You might be eligible for an expungement if you have successfully completed your probation and you are not currently serving time or facing new charges. While expungements can provide an opportunity for a fresh start, there are some limitations. An expungement cannot restore gun rights, remove sex-registration requirements, or keep evidence of a prior crime from being entered into court in a subsequent trial. A separate but related procedure involves requesting that a criminal record be sealed by the court and that related organizations destroy their records relating to the incident in question.
